Welcome to Faïença Broderie. “We”, “us” and “our” refer to Faïença Broderie. We operate this shop and website, including the related information, content, features, tools, products and services offered to provide customers with a personalised shopping experience (the “Services”). Our shop is powered by Shopify, which enables us to provide the Services.

These Terms of Service and the policies referenced in them describe your rights and responsibilities when using the Services. Please read them carefully. By visiting, using or purchasing through the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.

SECTION 2 — OUR PRODUCTS
We make reasonable efforts to display product colours, features and appearance accurately, but your screen may display them differently. Product descriptions, availability and quantities may change without notice. We may limit sales by person, region or jurisdiction and may discontinue products at any time. Handmade products may contain slight variations. Any offer is void where prohibited.

SECTION 3 — ORDERS
Placing an order is an offer to purchase. We may accept, reject or limit an order at our discretion, including orders that appear to be placed by resellers or distributors. An order is accepted when we send confirmation. If we change or cancel an order, we may contact you using the details provided. Please review your order carefully before submitting it. Returns and exchanges are governed by our Refund Policy.

SECTION 4 — PRICES AND BILLING
Prices, promotions and discounts may change without notice. The price charged is the price shown when the order is placed, together with applicable delivery charges and taxes. Prices displayed online may differ from prices offered elsewhere. You agree to provide complete, current and accurate billing and payment information and to update it when necessary.

SECTION 5 — SHIPPING AND DELIVERY
Processing and delivery times are estimates and are not guaranteed. We are not responsible for delays caused by carriers, customs or circumstances beyond our reasonable control. Responsibility for providing a complete and accurate delivery address rests with the customer. Please see our Shipping Policy for the applicable areas, carriers, charges, times and tracking arrangements.

SECTION 6 — INTELLECTUAL PROPERTY
The Services and all associated content—including trademarks, branding, text, photographs, graphics, reviews, video, audio, designs, product names, PDF files, patterns and instructions—belong to Faïença Broderie, its affiliates or its licensors and are protected by intellectual-property laws. These Terms permit personal, non-commercial use of the Services only. You may not copy, reproduce, distribute, modify, publish, sell or exploit protected content without prior written permission. Purchasing a PDF pattern does not grant commercial reproduction rights.

SECTION 7 — OPTIONAL TOOLS
We may provide access to third-party tools that we do not monitor or control. Such tools are provided “as is” and “as available”, without warranties or endorsement. Your use of optional tools is at your own risk and subject to the relevant third party’s terms.

SECTION 8 — THIRD-PARTY LINKS
The Services may contain links or content supplied by third parties. We are not responsible for examining or evaluating third-party websites, products, services, content or accuracy. We are not liable for loss arising from your use of third-party sites or transactions. Review the third party’s policies before proceeding.

SECTION 9 — RELATIONSHIP WITH SHOPIFY
Faïença Broderie uses Shopify to provide the Services. Purchases are made directly from Faïença Broderie, not Shopify. To the fullest extent permitted by law, Shopify is not responsible for transactions, products, customer service, injuries, damage or losses arising from purchases made through our shop. You release Shopify and its affiliates from claims arising from transactions with us, except where the law does not permit such a release.

SECTION 10 — PRIVACY POLICY
Personal information collected through the Services is governed by our Privacy Policy. Because Shopify hosts the shop, Shopify also processes information relating to your access and use. Please read both our Privacy Policy and Shopify’s privacy information to understand how data is handled.

If you submit ideas, suggestions, reviews or other feedback, you grant us a worldwide, perpetual, transferable, sublicensable, royalty-free licence to use, reproduce, modify, publish and distribute it for any purpose, subject to applicable law. You may not use the Services to break the law; infringe intellectual-property rights; harass, abuse, discriminate against or harm others; submit false or misleading information; transmit malicious code; collect personal information unlawfully; send spam; interfere with security; scrape or circumvent access controls; or engage in obscene or immoral activity. You agree to indemnify and hold harmless Faïença Broderie, Shopify and their respective affiliates, officers, employees, agents, contractors and service providers from third-party claims arising from your breach of these Terms, violation of law or infringement of another person’s rights, to the extent permitted by applicable law.

SECTION 18 — SEVERABILITY
If any provision is found unlawful, void or unenforceable, that provision will be enforced to the maximum extent permitted and separated from these Terms. The remaining provisions remain valid.

SECTION 19 — WAIVER AND ENTIRE AGREEMENT
Failure to enforce a provision is not a waiver. These Terms and the policies posted on the Website form the entire agreement governing the Services and replace earlier communications or agreements on the same subject. Ambiguities are not interpreted against the drafting party.

SECTION 20 — ASSIGNMENT
You may not transfer or assign these Terms or your rights and obligations without our prior written consent. We may transfer or assign these Terms and our rights and obligations as permitted by law.

SECTION 21 — GOVERNING LAW
These Terms and any separate agreement through which we provide Services are governed by the laws applicable where Faïença Broderie has its registered office. The competent courts are determined in accordance with applicable consumer-protection and procedural law.

The latest version of these Terms is available on this page. We may update or replace any part by publishing changes on the Website. Material changes will be communicated where required by law and take effect on the date stated in the notice. Continued use after changes take effect constitutes acceptance.
